TERMS OF SERVICE

The following is the Lawyerindia.co. in (Author, Company, Firm, Our, Publisher, Us, We, lawyerindia.co.in, eCreative Systems). This terms and conditions defines that you (Client, Customer, You, Your, Subscriber, User or Users) agree to when you use our website (Site) as an anonymous or registered user with Lawyerindia.co.in.

By submitting your order and providing your information on our system, you accept and agree without limitation or qualification, to all of the terms and conditions in this Agreement (Terms of Service) as described herein.

We reserves the right to update or change the terms, conditions and notices of its services from time to time to reflect changes in the service, changes in the laws affecting the services, or for any other reasons. In such event, new Terms of Service will be posted on the site and your continued participation in the service shall be considered as your acceptance and agreement with the new Terms of Service.

We reserve the right to cancel any account, including files and content, for any reason, or no reason at all, at any time. You agree to maintain backup files of all information you post on website and you agree that we will have no liability for removing any data you have posted.

Illegal Use
Our network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, and violates export control laws or anti national.

Payment
Customer will pay the service fees to us in the manner set forth in the order. Payment is in advance of the time period during which such services are provided. Customer agrees that all set up fees, if such fees are indicated in the order, are non-refundable once the setup is completed. These services will be billed on a recurring basis for the period of the service unless you have notified us in advance to change the period of the service.

Customer agrees not to use excess of what is allowed to the service of which the customer ordered. If Customer uses an excess amount of storage, bandwidth or any other resource, over what he purchased, we will charge the customer additional fees. Customer has the sole responsibility to monitor, check and correct, if so required, the usage of the service.

Service fees do not include any applicable taxes. All paid fees are fully earned when due and are non-refundable when paid. Unless otherwise noted, invoices for the service fees shall be due and payable within 5 days after the date of the invoice. If Customer fails to pay invoice within 5 days after the date of the invoice, we may charge customer overdue fee or discontinue the service. If we collects any payment due through an attorney or collection agency or we prevails in any dispute actions which we and customer are parties, customer will pay all costs of collections, arbitration and litigation including attorneys' fees. If check is returned for insufficient funds, we may charge additional processing fee per occurrence.

Customer acknowledges and agrees that you are the person legally responsible for use of this account and that you are at least 18 years of age. Customer agrees to provide current and accurate postal address, telephone number and email address for our records. Furthermore, you agree that you are the authorized user of the credit card that you have supplied to us. You also understand and agree that we have the right and obligation to either investigate or provide an outside agency and authority any information we may have in relation to the account to investigate possible fraudulent use of credit card.

Member Account, Password and Security
You will receive a password and account designation upon completing the registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify us of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section. This is a single user email account and the responsibility lies with the person by whom it is registered in case it is shared between multiple users.

Email
It is a condition of use of our services that subscriber do not post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any local, state, national or international law; post or transmit any information, software or any other material which violates or infringes upon the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder; post or transmit any information, software or other material, which contains a virus or other harmful component; post, transmit or in any way exploit any information, software or other material for commercial purposes, or which contains advertising.

Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A subscriber shall not use another site's mail server to relay mail without the express permission of the site. Posting a message and subscribing without intent to large number of news groups, forums, email, mailing lists or other groups or lists is prohibited.

The virus scanner may not be able to detect or repair all viruses and variants. Please be aware that there is a risk involved whenever downloading email attachments to your computer or sending email attachments to others, and that, as provided in the Terms of Service, neither us nor its licensors are responsible for any damages caused by your decision to do so. We recommends that you never download documents from an unknown source.

Bulk Mail, Spam and Spam Filtering
We does not authorize the use of its systems and network to accept, transmit or distribute solicited or unsolicited bulk email, either opt-in or opt-out. Sending bulk email or any other unsolicited advertising in Internet is considered as spam and it is annoyance to others. Spamming Internet users via us or directed towards domains or services which resides on us is strictly prohibited and may cause your services to be terminated immediately and without warning. You will be fully responsible for any damages to you, us, or any other party or parties resulting from such activities.

Without any SPAM filtering the amount of email SPAM will be unbearable and counter productive to the use of email to our users. We are using the following system-level anti-SPAM measures:

Incoming emails must come from domains that accept reply emails. If a domain does not exist, or it exists but reply mail is deactivated (meaning their DNS entry has no "MX" record), we will reject the mail.

Customer Rights and Obligations
Subscriber shall use our services for lawful purposes only. Subscriber shall not post or transmit using our services any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give right to civil liability or otherwise violate any law, or which, without the our express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a subscriber that in our discretion restricts or inhibits any other subscriber from using or enjoying our services will not be permitted. Subscriber shall not use our services to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with our services.

Subscriber shall not upload, post or otherwise make available using our services any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with subscriber. Subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission.

System and Network Security
Violation of system or network security are prohibited, and may result in criminal and Civil Liability. We will investigate incidents involving such violations and may involve/will cooperate with law enforcement agencies if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:

Indemnification
Subscribers agree to defend, indemnify and hold harmless to us, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorney's fees, arising out of the use of our services by subscriber or any body else than the subscriber, if any.

Parts of the pages or the complete publication including all offers and information might be extended, changed or partly or completely deleted by the author without separate announcement. We maximum aggregate liability to customer related to claim arising under this agreement will be limited to the total amount paid by customer for the last year.

Applicable Law and Jurisdiction
This service is based and operated in Pune, Maharashtra, India. The State of Maharashtra, India, governs this agreement. If any provision of this agreement is found to be invalid by any court competing jurisdiction, this invalidity shall not affect the validity of the remaining provisions of this agreement, which shall remain in full force and effect. No waiver of any term of this agreement shall be deemed a further or continuing waiver of such term or any other term.

Prior Agreements
This agreement supersedes any written, electronic, or oral communication you may have had with us or any agent or representative thereof, and constitutes the complete and total agreement between the parties.

Legal Validity
If any provision of this agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect and said provision shall be reformed only to the extent necessary to make it enforceable.
